These Terms and Conditions govern your use of the website www.suviksan.in, including all content, services, courses, and products offered by Suviksan Learning & Development, an affiliate of Suviksan Technologies Pvt. Ltd.
By accessing, browsing, or using our Website and Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Notice. If you do not agree with these Terms, you must not access or use our Website or Services.
1. Use of Our Services
a. Eligibility:
To use our Services, you must be at least 18 years of age, or the age of legal majority in your jurisdiction. Individuals under the age of 18 (or the applicable age of consent in their country, e.g., 16 in the UK, 13 in the US) may not create an account but may use the Services only if a parent or legal guardian creates an account and enrolls them in a Course. The parent or guardian is responsible for the minor's activities and compliance with these Terms.
b. Your Account:
To access certain features, such as enrolling in courses, you must register for an account. You agree to:
- Provide accurate, current, and complete information during the registration process.
- Maintain and promptly update your account information.
- Keep your password secure and confidential. You are solely responsible for all activities that occur under your account.
- Notify us immediately at Learning@suviksan.com of any unauthorized use of your account.
We reserve the right to suspend or terminate your account if any information provided is found to be inaccurate, not current, or incomplete, or if you violate any of these Terms.
2. Courses, Payments, and Refunds
a. Course Enrollment:
When you purchase a course, you are granted a limited, non-exclusive, non-transferable license to access and view the course content for your personal, non-commercial, educational purposes only. You are not granted any right to resell, reproduce, redistribute, or publicly display the course in any way.
b. Payments:
All payments for our Services are processed through secure third-party payment gateway providers, such as CashFree. We do not collect or store your credit/debit card details. By making a purchase, you agree to the terms and conditions of our payment providers. All prices are listed in the applicable currency and are subject to change without notice.
c. Refunds:
All purchases of courses and services are final and non-refundable. Once a purchase is made, no refunds will be issued under any circumstances. We encourage you to review the course details and previews carefully before making a purchase.
3. User Conduct and Responsibilities
You agree to use the Services in a lawful manner and in compliance with all applicable laws and regulations. You agree not to:
- Post, upload, or share any content that is unlawful, harmful, defamatory, obscene, or racially, ethnically, or otherwise objectionable.
- Infringe upon the intellectual property rights of Suviksan L&D or any third party.
- Share your account credentials or allow anyone else to access your account.
- Attempt to access, scrape, or systematically retrieve data or content from the Website without our express written permission.
- Introduce any viruses, trojan horses, worms, or other material that is malicious or technologically harmful.
- Use the Services for any commercial purpose or for the benefit of any third party without our prior written consent.
4. User-Generated Content
You may be able to post content, such as profile information, blog comments, or feedback ("User Content"). You retain ownership of your User Content. However, by posting User Content, you grant Suviksan L&D a worldwide, non-exclusive, royalty-free, perpetual license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute your User Content in any and all media or distribution methods.
You are solely responsible for your User Content and the consequences of posting it. We do not endorse any User Content and reserve the right to remove any content that violates these Terms, at our sole discretion.
5. Intellectual Property
All content on the Website, including but not limited to text, graphics, logos, images, course materials, videos, and software, is the property of Suviksan L&D or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws. All rights are reserved.
6. Third-Party Services and Links
Our Services may integrate with or provide links to third-party websites and services (e.g., Classplus for our LMS, Google Analytics, social media sites). We are not responsible for the privacy practices, content, or terms of these third-party services. Your use of any third-party service is at your own risk, and you should review their applicable terms and privacy policies.
7. Disclaimers
THE SERVICES AND ALL INCLUDED CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. SUVIKSAN L&D SPECIFICALLY DISCLAIMS ANY AND ALL WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, NOR DO WE MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES, OR THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY INFORMATION OBTAINED THROUGH THE SERVICES. YOUR ENROLLMENT IN A COURSE DOES NOT GUARANTEE ANY SPECIFIC OUTCOME, INCLUDING EMPLOYMENT OR CAREER ADVANCEMENT.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SUVIKSAN L&D, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; OR (III) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
OUR TOTAL LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT OF FEES PAID BY YOU TO SUVIKSAN L&D IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.
9. Indemnification
You agree to defend, indemnify, and hold harmless Suviksan L&D and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; or (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right.
10. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Noida, Uttar Pradesh, India to resolve any legal matter arising from these Terms.
11. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide notice on our Website and/or by email. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms.
